Congress created Chapter 12 in 1986 in direct response to the farm crisis of the 1980s, when neither Chapter 11 nor Chapter 13 fit the realities of family agriculture. Chapter 12 is built around how farmers actually earn: in seasonal cycles, against the value of land and equipment, and under conditions that no calendar year can fully predict.
How Chapter 12 differs from Chapter 13
Chapter 13 has rigid debt limits and a payment structure designed for wage earners. Chapter 12 has substantially higher debt ceilings, allows annual or semi-annual plan payments rather than monthly, and provides far more flexibility in the treatment of secured agricultural debt, including the ability to reduce a secured creditor's claim to the present value of the underlying collateral.
Eligibility requirements
- The debtor must qualify as a family farmer or family fisherman as defined by the bankruptcy code.
- A specified percentage of total debt must arise from the farming or fishing operation.
- Total aggregate debt must fall within the Chapter 12 debt ceiling, which is adjusted periodically by Congress.
- A specified percentage of gross income must come from the farming or fishing operation.
How the repayment plan is structured
The debtor proposes a plan, typically over three to five years, that pays creditors out of farm income. Secured debts on land and equipment can be restructured at the actual present value of the collateral, with the remaining unsecured portion treated alongside other general unsecured claims. Payments can be timed to the harvest cycle rather than forced into a monthly schedule that has nothing to do with how the operation generates revenue.
